Will My Data be Confidential?

Not necessarily; if you have sensitive Trade Secrets, you should work with your reporters and/or your verifiers to ensure this information is marked “non emissions data—Confidential/Trade Secrets.” Otherwise, all emissions data is considered public information.

Although emissions data is considered public information, information designated as “non-emissions data” may be classified as confidential trade secrets or otherwise exempt from public disclosure. Requests for confidentiality will presumably be an issue if a facility is being audited under § 95105. Confidentiality requests are handled under Title 17, CFR § 91000 to 91022.
